Grounds for divorce:
1. Adultery
2.Unreasonable behaviour
3. Living apart for more than two years
4. Living apart for more than five years
5. Desertion
Adultery :
Adultery is extramarital sex that is considered objectionable
On social, religious , moral or legal grounds. A single act of sexual intercourse is generally sufficient to constitute adultery. Sec 497 of the indian penal code deals with adultery.
Unreasonable behaviour :
The unreasonable behaviour means the other party find it intolerable to live with him/her. This can include domestic violence drunkenness. The unreasonable behaviour can lead to divorce.
Living apart for more than two years :
If you are living apart from the spouse for more than two years with agreement than the divorce can be filed and both the parties aree agree for the divorce then divorce can be taken.
Living apart for more than five years :
If you and your spouse is living apart for more than five years without agreement if one of the party is not agreed for the divorce then this can be a ground for divorce.
Desertion :
It is defined as one person in the marriage deserting other for a continuous period of at least two years . This means that one person has left the other without agreement or for a good reason. Desertion is rarely used because it can be hard to prove as it relies on proving the intent was there.
Stages of divorce :
There are five stages of divorce these are :-
- Cognitive separation
- Emotional divorce
- Physical separation
- Legal dissolution
- Spiritual un-bonding
